These Terms & Conditions govern your use of the MediSero patient application. Please read them carefully before using the App. By creating an account or continuing to use the App, you agree to be bound by these Terms.
1. Acceptance of Terms
These Terms & Conditions ("Terms") form a legally binding agreement between you ("User", "you", "your") and MediSero Technologies Private Limited ("MediSero", "we", "our", "us"), a company incorporated under the Companies Act, 2013 with its registered office at [Registered office address], India. These Terms are published in accordance with Rule 3(1) of the Information Technology (Intermediary Guidelines and Digital Media Ethics Code) Rules, 2021 and constitute an electronic record under the Information Technology Act, 2000.
By installing, accessing or continuing to use the App, you represent that you have read, understood and agree to be bound by these Terms, our Privacy Policy and any supplementary notices we publish from time to time. If you do not agree, you must stop using the App immediately.
2. Eligibility
You may use the App if you are at least 18 years old and competent to contract under the Indian Contract Act, 1872. If you are below 18, you may only use the App under the supervision and verifiable consent of a parent or legal guardian, and the parent or guardian will be deemed to have entered into these Terms on your behalf. We reserve the right to verify age and to terminate any account that does not meet these requirements.
3. The Service
MediSero provides a personal health management platform that allows you to:
- Maintain a longitudinal electronic health record of your visits, prescriptions, lab reports, vitals and medications.
- Record a doctor visit (with the doctor’s permission) and receive an AI-assisted transcript, summary and SOAP-style notes through our AI assistant, Clio.
- Receive personalised reminders for medications, appointments, refills and follow-ups.
- Connect wearables and health apps such as Apple Health, Apple Watch, Google Health Connect, Samsung Health, Fitbit and Garmin to centralise your vitals.
- Discover and book consultations with healthcare providers who are part of the MediSero network.
- Share prescriptions and reports with pharmacies, labs and family members when you choose to.
4. Not a medical device or substitute for professional advice
MediSero is an informational and organisational tool. It is not a medical device, does not diagnose medical conditions and does not replace consultation with a registered medical practitioner.
Any information generated by Clio or displayed in the App — including summaries, drug-interaction alerts, daily insights and trend analysis — is for your general information and self-management only. It is not medical advice and must not be relied upon as a substitute for examination, diagnosis or treatment by a qualified healthcare professional. Always seek the advice of your doctor or another qualified health provider with any questions you may have regarding a medical condition.
In case of a medical emergency, call the nearest hospital or the national emergency number 112 immediately. Do not use the App to seek emergency care.
5. Telemedicine services
Where the App enables you to consult a Registered Medical Practitioner ("RMP") remotely, such consultations are provided solely by the RMP in accordance with the Telemedicine Practice Guidelines, 2020 issued under the Indian Medical Council Act, 1956 (now the National Medical Commission Act, 2019). MediSero acts only as a technology intermediary facilitating the consultation. The doctor-patient relationship is formed directly with the RMP, and the RMP is solely responsible for the clinical decisions, prescriptions and advice given during such consultation.
6. Account registration and security
- You must provide accurate, current and complete information when creating your MediSero account.
- You are responsible for maintaining the confidentiality of your login credentials, device PIN and biometric authentication.
- You agree to notify us immediately of any unauthorised access to or use of your account.
- You may not create more than one account for the same individual or transfer your account to anyone else.
7. Permitted use
Subject to these Terms, MediSero grants you a limited, non-exclusive, non-transferable, non-sublicensable, revocable licence to install and use the App on a device you own or control, solely for your personal, non-commercial health management.
8. Prohibited conduct
You agree not to, and not to allow any third party to, directly or indirectly:
- Use the App in any manner that violates any applicable law, including the IT Act 2000, the DPDP Act 2023, the Drugs and Cosmetics Act 1940 or the Telemedicine Practice Guidelines 2020.
- Reverse engineer, decompile, disassemble or attempt to derive the source code of the App, except to the extent permitted by law.
- Upload, transmit or distribute any content that is unlawful, defamatory, obscene, misleading, fraudulent, infringing, harassing or otherwise objectionable.
- Impersonate any person, including any doctor, pharmacist, clinical establishment or MediSero staff.
- Attempt to gain unauthorised access to the App, other users’ accounts, or any systems or networks connected to the App.
- Use the App to record any individual (including a doctor) without their knowledge or consent where such consent is required by law.
- Use the App to transmit viruses, worms, trojans or any malicious code.
- Scrape, harvest or otherwise extract data from the App by automated means without our prior written consent.
- Use the App to solicit or provide medical advice if you are not a Registered Medical Practitioner authorised to do so.
9. User content and licence to MediSero
You retain ownership of the health information and other content you upload to the App ("User Content"). By submitting User Content, you grant MediSero a non-exclusive, royalty-free, worldwide licence to host, store, transmit, adapt and display the User Content solely for the purpose of providing the App and its features to you. We will not use your identifiable User Content to train Clio or any other AI model. You represent and warrant that you have all rights necessary to grant this licence.
10. Intellectual property
The App, including its software, design, trademarks, logos, text, graphics, Clio AI models and all related intellectual property, is owned by MediSero or its licensors and is protected by Indian and international copyright, trademark and other intellectual property laws. These Terms do not transfer any ownership or intellectual property rights to you, other than the limited licence set out in Section 7.
11. Third-party services and content
The App integrates with third-party services such as Apple Health, Apple Watch, Google Health Connect, Samsung Health, Fitbit, Garmin, WHOOP, payment gateways and SMS providers. Your use of these services is subject to the respective third party’s terms and privacy policies. MediSero is not responsible for the availability, accuracy or reliability of third-party services or content, and you use them at your own risk.
12. Fees, subscriptions and refunds
Certain features of the App may be offered on a paid or subscription basis. Prices, billing cycles and inclusions will be disclosed to you before you subscribe. Payments are processed through RBI-regulated payment gateways. Unless expressly stated otherwise, subscription fees are non-refundable except as required by applicable consumer protection law. Taxes, including GST, will be applied as per prevailing rates.
13. AI features and limitations
Clio is an AI assistant designed to help you understand and organise your health information. Clio can make mistakes. Outputs may be incomplete, inaccurate or out of date. You must independently verify any medically significant information with a qualified healthcare professional before acting on it. MediSero makes no representation or warranty that Clio’s outputs are suitable for any clinical purpose.
14. Service availability
We strive to keep the App available at all times, but we do not guarantee uninterrupted or error-free operation. We may suspend, restrict or modify the App, or any feature, at any time for maintenance, security, regulatory or business reasons. We will give reasonable advance notice for planned downtime where practicable.
Beta and pre-release versions: From time to time MediSero distributes pre-release builds of the App through external testing programmes such as Apple TestFlight, Google Play closed testing, or directly to invited users. If you participate in such testing, you acknowledge that (a) the App is under active development and may contain defects, missing features and inaccurate results; (b) features, screens and data formats may change without notice between builds; (c) test data, draft records and locally-cached health information may be reset, migrated or deleted as part of a release; (d) you will not rely on a beta build for any time-critical clinical decision; (e) MediSero may collect additional crash logs, performance traces and feedback you submit through the testing platform in order to fix defects, and (f) you will not redistribute the build, screenshots or feedback you receive without our written consent. The disclaimers and limitations of liability in sections 15 and 16 apply with full force to any beta or pre-release version.
15. Disclaimer of warranties
To the maximum extent permitted by law, the App is provided on an "as is" and "as available" basis, without warranties of any kind, whether express, implied or statutory, including warranties of merchantability, fitness for a particular purpose, non-infringement, accuracy or reliability. MediSero does not warrant that the App will meet your requirements, that defects will be corrected or that the App will be free from viruses or other harmful components.
16. Limitation of liability
To the maximum extent permitted by law, in no event shall MediSero, its directors, employees, affiliates, agents or licensors be liable for any indirect, incidental, consequential, special, exemplary or punitive damages, including loss of profits, data, goodwill or business opportunity, arising out of or in connection with your use of, or inability to use, the App, even if we have been advised of the possibility of such damages.
Our aggregate liability to you for any and all claims arising out of or relating to the App or these Terms shall not exceed the higher of (a) the amounts you have paid to MediSero in the twelve (12) months preceding the event giving rise to the claim, or (b) INR 1,000. Nothing in these Terms limits any liability that cannot be limited under applicable law.
17. Indemnity
You agree to defend, indemnify and hold harmless MediSero, its affiliates and their respective directors, officers, employees and agents from and against any and all claims, damages, liabilities, losses and expenses, including reasonable attorneys’ fees, arising out of or in any way connected with (a) your use of the App, (b) your breach of these Terms, (c) your violation of any applicable law, or (d) your infringement of any third-party right, including intellectual property or privacy rights.
18. Termination
You may stop using the App and delete your account at any time from Profile → Account. We may suspend or terminate your access to the App if we reasonably believe you have breached these Terms, violated applicable law, or posed a risk to the security or integrity of the App or other users. On termination, the licences granted to you will cease, and MediSero may delete your data as described in the Privacy Policy.
19. Grievance redressal
In accordance with Rule 3(2) of the IT Rules 2021, you may contact the MediSero Grievance Officer with any complaint:

We will acknowledge complaints within 24 hours and resolve them within 15 days of receipt. If your complaint relates to unlawful content, we will take appropriate action as required by law.
20. Consumer rights
Nothing in these Terms limits any statutory right you may have as a "consumer" under the Consumer Protection Act, 2019. If you believe we have failed to meet our obligations, you may also approach the appropriate consumer disputes redressal forum.
21. Force majeure
MediSero shall not be liable for any failure or delay in performing its obligations under these Terms to the extent such failure or delay is caused by events beyond its reasonable control, including acts of God, war, terrorism, riots, epidemics, pandemics, government actions, internet or telecommunications failures, power failures or industrial disputes.
22. Changes to these Terms
We may update these Terms from time to time. If we make material changes, we will notify you through the App or by email. Your continued use of the App after the effective date of the updated Terms constitutes your acceptance of the changes. If you do not agree to the updated Terms, you must stop using the App.
23. Severability and waiver
If any provision of these Terms is held to be invalid or unenforceable by a court of competent jurisdiction, the remaining provisions will remain in full force and effect. Our failure to enforce any right or provision of these Terms will not be deemed a waiver of such right or provision.
24. Governing law and dispute resolution
These Terms are governed by and construed in accordance with the laws of India. Any dispute, controversy or claim arising out of or relating to these Terms, including their formation, validity or termination, shall first be attempted to be resolved amicably between the parties within 30 days of written notice. If not resolved, the dispute shall be referred to and finally resolved by arbitration under the Arbitration and Conciliation Act, 1996, before a sole arbitrator appointed by MediSero. The seat and venue of arbitration shall be , Karnataka, and the proceedings shall be conducted in English. Subject to the arbitration clause, the courts at shall have exclusive jurisdiction.
